Welcome to Morphe.
These Terms of Service ("Terms") govern your access to and use of the Morphe website, including www.morphe.in, and any other websites, online stores, digital platforms, applications, features, content, products and services operated or made available by or on behalf of Morphe (collectively, the "Services").
In these Terms, "Morphe", "we", "us" and "our" refer to Creative Impex, trading under the brand name Morphe, having its registered/principal office at Shed No 16, DSIIDC SHED SCHEME III, Okhla Industrial Estate Phase 2, New Delhi, Delhi 110020.
By accessing, browsing or using the Services, or by placing an order through the Services, you acknowledge that you have read, understood and agreed to these Terms, together with our Privacy Policy, Shipping Policy and Returns & Refund Policy, each of which forms part of these Terms.
If you do not agree to these Terms, please do not use the Services.
These Terms apply to customers purchasing products for personal or household use. If you are purchasing products for commercial resale or other business purposes, please contact us separately.
1. ELIGIBILITY AND USE OF THE SERVICES
You must have the legal capacity to enter into a binding contract under the laws applicable to you in order to place an order through the Services.
If you are under the applicable age of majority, you may use the Services only with the involvement and consent of your parent or legal guardian, to the extent permitted by applicable law.
You agree to use the Services only for lawful purposes and in accordance with these Terms.
You are responsible for ensuring that the information you provide to us, including your name, email address, telephone number, billing information and shipping address, is accurate, complete and current.
If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account.
We reserve the right to suspend or restrict access to the Services where reasonably necessary to protect the Services, our business, our customers or third parties, including in cases involving suspected fraud, abuse, unlawful activity or violation of these Terms.
2. OUR PRODUCTS
We make reasonable efforts to ensure that product descriptions, photographs, colours, measurements, materials and other information displayed through the Services are accurate and up to date.
However, colours and appearance may vary depending on your device, display settings, lighting and other technical factors.
Minor variations in colour, texture, finish, measurements or appearance may occur as a result of manufacturing processes, fabric characteristics or other legitimate production variations.
Unless expressly stated otherwise, product images are for illustrative purposes and may not represent every individual variation of a product.
We reserve the right to modify product descriptions, specifications, availability, pricing and other product information at any time.
We may discontinue products or limit quantities available for purchase where reasonably necessary, including where stock is limited or where required by applicable law.
Nothing in these Terms excludes or limits any statutory rights or consumer guarantees that cannot lawfully be excluded.
3. ORDERS AND ACCEPTANCE
When you place an order through the Services, you are making an offer to purchase the products selected by you.
After you place an order, we may send you an order confirmation acknowledging receipt of your order. This confirmation does not necessarily mean that your order has been accepted.
An order is accepted when we confirm that the order has been accepted and/or dispatched, as applicable.
We reserve the right to refuse, cancel or limit an order where reasonably necessary, including where:
- the product is unavailable;
- there is an obvious pricing, product description or technical error;
- we are unable to fulfil the order;
- the delivery information provided is incomplete or incorrect;
- we reasonably suspect fraudulent, unauthorised or unlawful activity;
- the order appears to be intended for unauthorised resale or commercial distribution; or
- cancellation is otherwise required or permitted by applicable law.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled order in accordance with applicable law and our Refund Policy.
You are responsible for reviewing your order carefully before completing your purchase.
4. CANCELLATIONS
You may request cancellation of an order in accordance with our Cancellation Policy and subject to the stage of fulfilment of the order.
Once an order has been processed, packed or dispatched, cancellation may no longer be possible and the order may instead be subject to our Returns & Refund Policy.
Nothing in this section limits any cancellation or withdrawal rights that apply to you under mandatory local law.
5. PRICES, TAXES AND PAYMENTS
All prices displayed through the Services will be shown in the applicable currency and will include or exclude taxes, duties and delivery charges as indicated at checkout.
For purchases made in India, prices will generally be displayed in Indian Rupees (INR) and applicable taxes will be treated in accordance with Indian law.
For international purchases, the applicable currency, taxes, duties, shipping charges and other costs will be displayed or communicated where required by applicable law.
Depending on the destination country and delivery arrangement, customs duties, import taxes, local taxes, brokerage charges or other governmental charges may apply.
Where such charges are not collected at checkout, you may be responsible for them upon importation or delivery, subject to applicable law and the shipping terms applicable to your order.
Prices may change from time to time. The price applicable to your order will generally be the price displayed at the time your order is placed, subject to correction of obvious errors and applicable law.
We accept the payment methods made available through the Services at the time of purchase.
You represent that you are authorised to use the payment method provided.
Payment processing may be carried out by third-party payment service providers. We do not store complete payment-card information where payment processing is handled by such providers.
6. SHIPPING AND DELIVERY
Orders will be processed and delivered to the extent that delivery is available to the destination selected at checkout.
Estimated processing and delivery times will be communicated through the Services or at checkout.
Delivery times are estimates and may vary due to factors including:
- destination;
- customs and import procedures;
- carrier delays;
- weather or natural events;
- public holidays;
- incorrect or incomplete delivery information;
- security or regulatory requirements; and
- other circumstances beyond our reasonable control.
Where applicable law provides specific delivery rights or remedies, those rights will apply.
You are responsible for providing accurate delivery information.
If an order cannot be delivered because of incorrect or incomplete information provided by you, refusal of delivery, failure to accept delivery or repeated failed delivery attempts, additional charges or other consequences may apply to the extent permitted by applicable law.
For international orders, the customer may be responsible for complying with applicable import requirements and paying applicable duties and taxes unless otherwise stated at checkout.
Further details are available in our Shipping Policy.
7. RETURNS, EXCHANGES AND REFUNDS
Returns, exchanges, cancellations and refunds are governed by our Returns & Refund Policy, which forms part of these Terms.
Our Returns & Refund Policy sets out applicable eligibility requirements, return periods, exclusions, return shipping arrangements, exchange procedures and refund timelines.
Products must be returned in the condition required by the applicable Returns & Refund Policy, subject always to any mandatory rights available to you under applicable law.
Certain products may be subject to specific return or exchange conditions where permitted by applicable law, including personalised, altered, made-to-order, hygiene-sensitive or otherwise non-returnable products.
Nothing in our Returns & Refund Policy or these Terms is intended to exclude or restrict a consumer's statutory rights.
8. PRODUCT DEFECTS AND CONSUMER RIGHTS
If you receive a product that is defective, damaged, incorrect, materially different from its description or otherwise does not conform to applicable legal requirements, please contact us as soon as reasonably practicable.
Depending on the circumstances and applicable law, we may provide a repair, replacement, exchange, refund, price reduction or other appropriate remedy.
Certain jurisdictions provide consumers with mandatory guarantees, warranties or rights concerning product quality, conformity, safety and fitness for purpose. These rights apply regardless of anything stated in these Terms where they cannot lawfully be excluded.
For example, applicable local consumer laws may provide rights that differ from our standard commercial return policy.

If you are a consumer, nothing in these Terms is intended to deprive you of protections or mandatory rights granted to you by the laws of your country or place of residence where those rights cannot lawfully be excluded.
Where mandatory local law gives you the right to bring proceedings in a particular court or jurisdiction, those rights remain unaffected.
For customers who are not protected by mandatory consumer jurisdiction rules, the courts of [JURISDICTION] shall have jurisdiction over disputes arising from these Terms, subject to applicable law.
22. CHANGES TO THESE TERMS
